The 75-year-old driver of this cabin cruiser said that he couldn’t see the fishing boat because he was sitting down and his view was obstructed by the dashboard. On land, he gets around in a motorized scooter. The owner of the fishing boat is suing him for $372,500.

BS, at that speed he’s on plane and his bowrise angle can’t have been more than 5 or 6 degrees. so unless he can’t see over the steering wheel at that distance he could have seen them easily. He just got distracted or wasn’t looking is my bet.

Oh, I know, by law they have to be on the boat but not necessarily worn, but I just meant when it comes to situations like this when you suddenly have to jump into the water in the middle of a river and tread water for an undetermined amount of time, they could literally be a lifesaver, no matter how good of a swimmer you are.
The one fellow on the fishing boat was injured in the accident, imagine if he’d lost consciousness! :(

That seems pretty reasonable. Depending on what motor and electronics he had, that possibly could be a $50,000 boat, and you have to factor in the attorney’s cut, and there’s definitely emotional distress and room for punitive damages (public service, really, taking enough out of him to hurt might stop him from doing it again to someone else).
